Service Agreement & Engagement Terms

1. Nature of This Agreement
This Service Agreement governs the terms under which ASG Forensics ("we", "us", "the Company") provides digital forensic investigation, cryptocurrency tracing, cybercrime analysis, and related consultancy services to clients ("you", "the Client"). By submitting an intake request, making a payment, or commencing an engagement with ASG Forensics, you agree to be bound by these terms. These terms apply to all service categories offered by ASG Forensics unless a separate written engagement letter expressly supersedes a specific provision. In the event of conflict between this agreement and any other document, the terms of a signed written engagement letter will prevail.
2. How an Engagement Begins
An engagement with ASG Forensics proceeds through the following stages:
- Intake submission: The client submits an intake form describing the nature of the incident, the type of service required, and relevant background information. Submission of an intake form does not create a binding engagement.
- Review and assessment: ASG Forensics reviews the intake submission to determine whether the case falls within accepted case types under our Acceptable Use Policy, whether the requested services are appropriate to the described circumstances, and whether ASG Forensics has the capacity and expertise to take on the engagement.
- Scoping: If the case is accepted in principle, ASG Forensics will contact the client to define the scope of work, discuss the evidence to be analysed, and provide a fee estimate or fixed-price quotation.
- Acceptance and payment: The engagement is formally accepted when the client approves the scope of work and pays the required deposit or full fee. Work will not commence until payment has cleared.
- Commencement: Upon payment confirmation, the assigned analyst will begin the engagement and the client will be notified through the portal.
ASG Forensics is under no obligation to accept any engagement and may decline any request at its sole discretion, including after an initial acceptance, if new information comes to light that changes the assessment of the case.
3. Scope of Work
The scope of work for each engagement will be defined at the scoping stage and will specify the evidence to be analysed, the questions the analysis is intended to address, the deliverables to be produced, and the estimated timeline. Work performed by ASG Forensics is limited to the agreed scope. If the client wishes to expand the scope of work during an engagement — for example, by adding additional wallet addresses, devices, or analytical questions — this must be agreed in writing and may be subject to additional fees and revised timelines.
ASG Forensics will not conduct analysis beyond the agreed scope without explicit authorisation from the client. If, during the course of an engagement, the analyst discovers evidence that falls outside the agreed scope but is potentially relevant (for example, evidence of additional illicit activity), ASG Forensics will notify the client and discuss whether to expand the scope before proceeding.
4. Deliverables
The standard deliverable for a forensic investigation engagement is a written forensic report. Reports are delivered in PDF format through the client portal and include findings, methodology, exhibit references, chain of custody documentation, and analyst credentials. Additional deliverable formats (such as raw data exports, timeline visualisations, or expert witness summaries) may be available at additional cost and must be agreed during the scoping stage. Reports are delivered to the client's portal account only; delivery to third parties requires written authorisation from the client.
5. Timeline Expectations
Estimated timelines provided at the scoping stage are good-faith assessments based on the scope and complexity described at that time. Timelines may be affected by the volume and complexity of evidence received, technical issues encountered during analysis, the need for scope clarification with the client, or circumstances outside ASG Forensics' control. ASG Forensics will notify the client promptly if an engagement is expected to take materially longer than the original estimate. Clients should not treat estimated timelines as guaranteed delivery dates. ASG Forensics does not accept liability for decisions made by the client based on an assumed delivery date that is not met.
6. Client Obligations During an Engagement
The client is responsible for the following throughout the duration of an engagement:
- Providing complete, accurate, and truthful information about the circumstances of the case and the evidence submitted.
- Responding promptly to requests from the assigned analyst for clarification or additional information. Delays caused by the client's failure to respond may extend the timeline and are not the responsibility of ASG Forensics.
- Preserving all potentially relevant evidence and notifying ASG Forensics immediately if any evidence is accidentally modified, deleted, or lost during the engagement.
- Complying with all applicable laws in connection with the engagement, including data protection laws governing the personal data contained in submitted evidence.
- Ensuring that any authorised representative acting on the client's behalf has the authority to do so and is aware of all relevant obligations under this agreement.
7. Payment Terms
Fees for ASG Forensics services are set out in the quotation or engagement letter issued at the scoping stage. All fees are quoted in the currency specified in the quotation and are exclusive of any applicable taxes unless otherwise stated. A deposit of not less than fifty per cent (50%) of the agreed fee is required before work commences, with the balance due upon delivery of the final report, unless alternative arrangements are agreed in writing. Payment of the deposit constitutes acceptance of these engagement terms. All payments are subject to the Refund Policy published on this website, which is incorporated by reference into this agreement.
8. Cancellation and Termination
The client may request cancellation of an engagement at any time by notifying ASG Forensics in writing through the portal or by email. Cancellation does not automatically entitle the client to a refund. Refund eligibility is governed by the Refund Policy. ASG Forensics may terminate an engagement with immediate effect if: the client provides false information or evidence; the engagement is found to fall within a prohibited case type under the Acceptable Use Policy; the client fails to fulfil their obligations under this agreement; or continuation of the engagement would expose ASG Forensics to legal risk or regulatory liability. In the event of termination by ASG Forensics due to client misconduct, no refund will be issued and ASG Forensics reserves all rights at law.
9. Intellectual Property of Reports
Upon full payment of all fees due under an engagement, ASG Forensics grants the client a non-exclusive, non-transferable licence to use the forensic report for the purposes specified in the scope of work, which may include submission to banks, cryptocurrency exchanges, law enforcement agencies, regulatory bodies, or the client's legal counsel. The underlying intellectual property in the report — including the analytical methodology, writing, structure, and any proprietary tools or processes reflected in it — remains the property of ASG Forensics. Clients may not reproduce, sell, publish, or distribute the report in whole or in part to any party other than those authorised by the agreed scope, without prior written consent from ASG Forensics.
10. Consequences of Providing False Information
The accuracy of a forensic report is entirely dependent on the accuracy of the information and evidence provided by the client. If the client provides false, misleading, fabricated, or materially incomplete information — whether in the intake form, during evidence submission, or at any subsequent stage — the resulting report may be unreliable and may not reflect the true facts of the matter. ASG Forensics is not responsible for the accuracy of findings that are based on information that was false or misleading at the time of submission. In such cases, the client will not be entitled to a refund, and ASG Forensics reserves the right to withdraw any report issued under false pretences and to notify relevant authorities if a legal duty to do so arises.
11. Analyst Assignment
ASG Forensics assigns analysts to engagements based on case type, analyst expertise, and current workload. Clients may not request a specific analyst. ASG Forensics reserves the right to reassign an engagement to a different analyst at any time, including where the originally assigned analyst becomes unavailable. In such cases, the incoming analyst will be briefed on the case and the transition will be recorded in the case file. Quality standards are maintained regardless of which analyst is assigned.
12. Dispute Resolution
In the event of a dispute arising from an engagement, the client should first contact ASG Forensics in writing through the portal or at the support email address provided on our Contact page, setting out the nature of the dispute and the resolution sought. ASG Forensics will acknowledge the dispute within five (5) business days and will attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days of the written notice, either party may seek resolution through the courts of England and Wales, whose jurisdiction and applicable law shall govern this agreement unless a written engagement letter specifies otherwise.
13. Confidentiality During Engagement
All parties to an engagement are subject to the confidentiality obligations set out in the ASG Forensics Confidentiality Policy, which is incorporated by reference into this agreement. The confidentiality obligations apply to all information exchanged or generated during the engagement and survive the conclusion, cancellation, or termination of the engagement indefinitely, subject to the terms of the Confidentiality Policy.
14. Limitation of Liability
ASG Forensics' liability under any engagement is limited to the fees actually paid by the client for that engagement. ASG Forensics is not liable for any indirect, consequential, or speculative losses, including loss of profit, loss of opportunity, reputational damage, or any outcome arising from the use or non-use of a forensic report by a third party. ASG Forensics does not guarantee that its reports will be accepted by any bank, exchange, court, law enforcement agency, or other institution. Third parties make their own determinations independently, and their decisions are outside ASG Forensics' control or responsibility.
